THIS PAPER IS THE CO-WINNER OF THE FRED BERGER PRIZE IN PHILOSOPHY OF LAW FOR THE 1999 AMERICAN PHILOSOPHICAL ASSOCIATION FOR THE BEST PUBLISHED PAPER IN THE PREVIOUS TWO YEARS. -/- The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept. In a divided society, the CLS critique of this view is (...) overwhelming: there is no such justice that can command universal assent. But the liberal critique of CLS, that it degenerates into an unpalatable moral relativism on which there is no non-arbitrary basis between a justice that underwrites forms of domination such as slavery and a justice that condemns such forms of domination is equally powerful and compelling. I show that there is a way to harmonize both views that is subject to empirical test. -/- First I show that the most widely accepted and influential formulation of liberal justice, John Rawls' Justice as Fairness, in. e.g, A Theory of Justice, cannot avoid the relativistic challenge because it would not be accepted, as a matter of sociological fact, by real people in a divided society once the "veil of Ignorance" is removed and real people step out from the Original Position. To put it differently, different reflective equilibria are inevitable in a divided society. Given the weight that Rawls properly puts on the realizability of a conception of justice and its stability in practice, this is a fatal objection. There can be no divided society that is "well ordered" in Rawls' sense, governed by a shared conception of justice and known to be so governed. -/- I then turn to the most powerful statement of the CLS view, Milton's Fisk's relativistic account in The State and Justice. For Fisk, justice is a compromise between what the dominant groups can compel and what the the subordinate groups will acquiesce to., There is no one such compromise in any given situation, so the account is in that sense relativistic, but more deeply, it is relativistic in that it offers no non-arbitrary, non-question begging way to choose between the official justice of, e.g., a slaveholding society and and the radical justice of the slaves, which has no place for slaveholders as a group or slavery as an institution.All that Fisk can offer is an arbitrary existential choice: I'm with the slaves. (Or the slaveowners.) Most of us would find this disconcerting or even unacceptable. -/- I show that Fisk's general sort of account can be modified to allow for an non-arbitrary choice. Given general facts about human nature, societies based on domination will produce resistance that over the long run will diminish or eliminate various forms of domination. Through a sort of ratchet effect, rights won will be hard if not impossible to reverse. Societies embodying forms of domination can therefore be compared on dimensions of stability: the more domination, the more resistance, and the less stability. Such societies are inferior on the dimension of justice to more emancipatory society on the terms of both kinds of justice, official and radical. -/- This is not question begging because regimes of domination incorporate stability no less than more emancipatory social orders. The choice between official justice embodying domination and radical justice that does not is not arbitrary because it is based on a shared commitment to long term stability. This offers an empirical test of which social orders are more justice, and a prediction that over time, domination will tend to decrease. (shrink)

Interdisciplinarity is widely considered necessary to solving many contemporary problems, and new funding structures and instruments have been created to encourage interdisciplinary research at universities. In this article, we study a small technical university specializing in green technology which implemented a strategy aimed at promoting and developing interdisciplinary collaboration. It did so by reallocating its internal research funds for at least five years to “research platforms” that required researchers from at least two of the three schools within the university to (...) participate. Using data from semi-structured interviews from researchers in three of these platforms, we identify specific tensions that the strategy has generated in this case: in the allocation of platform resources, in the division of labor and disciplinary relations, in choices over scientific output and academic careers. We further show how the particular platform format exacerbates the identified tensions in our case. We suggest that certain features of the current platform policy incentivize shallow interdisciplinary interactions, highlighting potential limits on the value of attempting to push for interdisciplinarity through internal funding. Servant leadership has been theorized as a model where the moral virtue of humility co-exists with action-driven behavior. This article provides an empirical study that tests how these two apparently paradoxical aspects of servant leadership interact in generating follower engagement, while considering the hierarchical power of the leader as a contingency variable. Through a three-way moderation model, a study was conducted based on a sample of 232 people working in a diverse range of companies. The first finding is that humble (...) leaders showed the highest impact on follower engagement regardless of their hierarchical position. Less humble leaders in lower hierarchical positions seem to be able to compensate for that through a strong action-oriented leadership style. Most notably for leaders in high hierarchical positions, the moral virtue of humility seems to strengthen the impact of their action-oriented leadership the most. These findings provide empirical support and a better understanding of the interplay between the moral virtue of humility and the action-oriented behaviors of servant leadership. (shrink)

Although the neoconservative movement has come to dominate American conservatism, this movement has its origins in the old Marxist Left. Communists in their younger days, as the founders of neoconservatism, inverted Marxist doctrine by arguing that moral values and not economic forces were the primary movers of history. Yet the neoconservative critique of biotechnology still borrows heavily from Karl Marx and owes more to the German philosopher Martin Heidegger than to the Scottish philosopher and political economist Adam Smith. Loath to (...) identify these sources - or perhaps unaware of them - neoconservatives do not acknowledge these intellectual underpinnings or their implications. Thus, in the final analysis, their critique is incoherent and even internally inconsistent. By not acknowledging and embracing their intellectual roots, neoconservatives are left with a deeply ambivalent and often confused view of biotechnology and the society that gives rise to it. Lewis was not, and is not, very popular in the academy. I think there are three reasons.First, he did not stick to his subject, which was medieval and Renaissance literature. He wrote highly successful children's books, theological works, and articles accessible to nonspecialists, and was an acclaimed broadcaster. All this allowed his critics to suggest that he was not a proper academic, because proper academics do not throw their nets so wide.Second, he was good at everything he did (except perhaps (...) some areas of philosophy: he was famously bested by Elizabeth Anscombe when he ventured onto her home ground). This was perhaps the most infuriating thing about him. The justification for academic superspecialization is that one cannot do more than one thing really well. But Lewis did. He was a better Renaissance scholar than those who criticized him, moaned about him in the Oxford cloisters, and blackballed him for appointments. He is relentlessly readable; therefore (said his detractors) his scholarship must be shoddy.Lewis infuriates me too. Often, when I think I have had an original thought in some domain a million miles from Renaissance literature, I discover not only that Lewis had had that thought already, but had explicated it, seeing angles I never noticed, and more often than not he had exploded it, using a tenth of the words I used, and all in devastatingly simple prose that would entertain and illuminate the most uninterested plumber.And third, of course, he was a Christian, which was then becoming an unforgivable sin, as it remains now in the humanities (though not the physical sciences or mathematics). The usual (stated) objection to academic Christians is that their theological commitment precludes objectivity, but Lewis's academic writing (notably his English Literature in the Sixteenth Century: Excluding Drama [1954]) was so good that that indictment could not stick, and his opponents descended into incoherent fulmination about superannuated paradigms.These reasons help to explain the chilly reception (or, more often, nonreception) by self-billed “serious thinkers” of Lewis's “space trilogy”: Out of the Silent Planet, Perelandra, and That Hideous Strength (hereafter THS). In relation to THS there is another reason: the novel is about them. No, about us. Lewis's view of us is just too keen, his diagnosis too alarming.The main concerns of THS are dehumanization, the role of institutions in that dehumanization, and the desire of individuals to be part of an esoteric circle. More broadly, it concerns the nature of evil. Its debt to the Divine Comedy and to Charles Williams, Lewis's fellow Inkling, are clear.The central character is a young academic, Mark Studdock. We all know him. His education had been “neither scientific nor classical—merely ‘Modern.’ That left him pathetically manipulable. The severities both of abstraction and of high human tradition had passed him by: and he had neither peasant shrewdness nor aristocratic honour.” Studdock was “a man of straw, a glib examinee in subjects that require no exact knowledge.” He stood for nothing; he weighed nothing.Humans are not supposed to be weightless. We will do anything to convince ourselves that we have mass. Many of our strategies are counterproductive. Some are disastrous and lead to dissolution. Studdock's strategy is one of the commonest and most catastrophic: he tries to get to the center of things—to the “Inner Ring” whose geography is described by Lewis in his 1944 lecture (and later essay) of that name. At some level, at least occasionally, Studdock knows the stupidity of this ambition, but he closes his eyes and his mind. And he begins to be used by forces far greater than any he had dreamed of.The book opens with a merciless (and horribly entertaining) account of academic politics. Read it and cringe in recognition: the mechanics of toadyism; the devices for getting your own way with a committee (put the real business in coded form at the end of an agenda, to be dealt with on a hot day after lunch); infuse everything with an appeal to self-interest, but never put it quite like that, for fear of awakening long-dormant altruism. Obfuscate: do not call the sale of an ancient woodland in which Merlin's body lies “the sale of Bragdon Wood” but the sale of “the area coloured pink on the plan.” Learn to talk like the bursar of Studdock's college, for each of his sentences was “a model of lucidity: and if his hearers found the gist of his whole statement less clear than the parts, that may have been their fault.” As a manual for getting your own way in institutions, The Prince is artless and benign beside THS.Studdock becomes a pawn in a big and diabolical game. A vast organization, the National Institute for Coordinated Experiments, known, of course, as “NICE” (never underestimate the importance of an acronym), which turns out to be the instrument of dark supernatural forces, is becoming a state within a state. It is unaccountable. That is its tagline, indeed: it will be free of the red tape that inhibits the research of more conventional institutions. And who can define with sufficient exactitude the difference in principle between tedious administrative red tape and moral stricture? If you are in with the NICE, anything goes.The NICE's project is the unmaking of everything that is quintessentially human and, eventually, everything that is biological. Life itself is just too unhygienic. Beauty is a joke. Sentiment a delusion. Love merely a result of chemical interactions in the brain. Nothing signifies.The NICE has a handful of opponents—a raggedy bunch (including a bear) under the direction of Ransom, who has traveled outside planet Earth in the previous two books in the trilogy. The company, it turns out, is the remnant of the old Arthurian kingdom of Logres, which has always been in tension, if not war, with the modern kingdom of Britain: “Haven't you noticed that we are two countries? After every Arthur, a Mordred; behind every Milton, a Cromwell: a nation of poets, a nation of shopkeepers: the home of Sidney—and of Cecil Rhodes.” They recruit Studdock's wife, Jane, who can spy clairvoyantly on the NICE, and then a revived Merlin comes from his tomb to their aid.THS is strong meat. Many will balk at its supernaturalism, and perhaps in particular its complementarian view of the relationship between the sexes. But hear Lewis out: you might not agree with him, but he is always interesting. When I read THS thirty years ago, I thought it a ripping yarn. It still is. But now I see it as prescient, prophetic, and profoundly important. It should be on every university reading list, for every subject, and no one should be allowed to hold any kind of public office until they have shown that they have assimilated its lessons. Empirical research pertaining to cardiopulmonary resuscitation (CPR), clinician behaviors related to do-not-resuscitate (DNR) orders and substituted judgment suggests potential contributions to medical ethics. Research quantifying the likelihood of surviving CPR points to the need for further philosophical analysis of the limitations of the patient autonomy in decision making, the nature and definition of medical futility, and the relationship between futility and professional standards. Research on DNR orders has identified barriers to the goal of patient involvement in these life and death (...) discussions. The initial data on surrogate decision making also points to the need for a reexamination of the moral basis for substituted judgment, the moral authority of proxy decision making and the second-order status of the best interests standard. These examples of empirical research suggest that an interplay between empirical research, ethical analysis and policy development may represent a new form of interdisciplinary scholarship to improve clinical medicine. There is as yet no general agreement about exactly when Locke's Second Treatise of Government was written. Primarily as a result of Peter Laslett's arguments, the old assumption that it was written after the Revolution of 1688 has been abandoned, and it is almost universally agreed that both of the Two Treatises were written (apart from a small number of additions made in 1689) in the period between Locke's return to England from France at the end of April 1679 and (...) his departure for Holland in August 1683. An earliest possible date for the First Treatise can be established without difficulty. It cannot have been started before Filmer's Patriarcha was published in the winter of 1679-80, and probably not before Locke bought his own copy on 22 January 1680. Theories about the composition of the Second Treatise may therefore be divided into two classes: those which suppose, with Laslett, that it was begun in 1679, before Patriarcha was published, and therefore before Locke could have formed any intention of writing the First Treatise; and those which hold that it was not started until Locke had written at least the main part of the First. The second is of course the traditional view, and one that was taken for granted before Laslett's work; its most notable defender has been Richard Ashcraft, who has accepted Laslett's demolition of the 1689 dating, but has diverged from him in ascribing the Second Treatise to the period after the dissolution of the Oxford Parliament in March 1681. Ashcraft's criticisms of Laslett have been accepted by several recent writers, notably David Wootton, Mark Goldie and John Marshall, but they themselves have not agreed with each other or with Ashcraft in their positive claims. The whole question is therefore worth examining again. (shrink)

Some see health care as primarily an individual responsibility. Others see it as a public responsibility. Behind these approaches are strong conflicting beliefs about ethical matters, specifically about the kind of good that health care is. On the one side the underlying belief is that health care is no more than an individual good and hence calls for a distributive policy based on the market. On the other side the underlying belief is that it is a public good and hence (...) calls for a distributive policy based on widespread agreement.' There will be intermediate approaches which try with varying success to justify themselves by piecing together beliefs from both sides. I shall explain what is involved in calling something a public good. Then I shall try to show that, if health care is to satisfy some rather plausible criteria, it must have the character of a public good. (shrink)

This article describes the implications for religious toleration of various non-cognitive views of religious belief, especially those adopted by Thomas Hobbes, Baruch Spinoza, John Locke, and Pierre Bayle. It suggests that while these men were of very different philosophical outlook, they did all share a deep hostility to the combination of clerical intolerance, scholastic philosophy, and pagan superstition that Hobbes labelled the Kingdom of Darkness. They all firmly held the view that the clergy should never wield power and they only (...) differed on the powers the civil authorities possessed over religion. (shrink)

The commentary on Plato's Republic by Proclus (d. 485 CE), which takes the form of a series of essays, is the only sustained treatment of the dialogue to survive from antiquity. This three-volume edition presents the first complete English translation of Proclus' text, together with a general introduction that argues for the unity of Proclus' Commentary and orients the reader to the use which the Neoplatonists made of Plato's Republic in their educational program. Each volume is completed by a Greek (...) word index and an English-Greek glossary that will help non-specialists to track the occurrence of key terms throughout the translated text. The second volume of the edition presents Proclus' essays on the tripartite soul and the virtues, female philosopher rulers, and the metaphysics and epistemology of the central books of the Republic. One can make the case that we have lost the capacity for abstract thought. When we read or listen to the radio, the mind forms images in response to the suggestion. The same thing can be said to occur when an illustration provokes the viewer by its symbolic relationship to reality. Abstraction encourages the mind to bridge the distance from suggestion to reality. Art is the most benign and fundamental way of creating community that our species has discovered.

Ageing bodies are too often associated with invisibility or ‘active’ and ‘successful ageing’ discourses. Little research has focused on the daily and lived experiences of ageing, gender and sexuality in midlife, particularly when it comes to positive or more nuanced experiences. Based on ethnographic research in salsa classes with women in their fifties, this article explores the intersections and co-production of ageing, femininity and heterosexualities within particular spaces. Single women in midlife initially felt unsure of the ‘rules of the road’, (...) out of place in social space. Salsa class spaces were produced as safe, alongside a ‘safe sensuality’ – which included embodying a glamorous salsa outfit but remaining respectfully feminine in ‘age appropriate’ ways. Participants navigated a way to become ‘more’ rather than ‘less’ of themselves with age, enjoying a ‘second chance’ which had not been afforded to the women of the generations before them. This article extends queer studies of space to account for ageing and for the hierarchies embodied within heteronormativities. (shrink)
